7. Charges

has mortgages, liens or any other encumbrances. If any of the above is present, accurate cargo information is provided.
8. Date
Here you will see the date on which the nota simple was issued and whether there are any documents pending in the office.
What is the meaning of fiscal affectation in a nota simple?
Also known as nota marginal de afección fiscal, this is the payment notice that the registrar places each time the property is transferred from one owner to another. This is because this operation is subject to transfer tax ITP or inheritance and gift tax ISD.
According to the law, the new owner is liable with the property itself within a period of four to five years for the payment of the taxes that are generated or that have been levied in some previous inheritances. In a nutshell, the tax liability note is for the new owner to be aware of this liability.

What if the nota simple says there is no house on this land, can I still buy the property?
If you can buy it. The most common cases are houses that are built illegally on land that has been classified as rustic. The value of the house is much less, but the notary will allow you to buy the property. If you do so, you have two options.
- You can try to register the house, although if it was built illegally, this will be very difficult.
- He can do nothing and hope that he can find a buyer to pay at least what he paid for it.
However, be aware that if a house is built illegally, the government can decide to demolish it at any time. This does not happen too often, but it does happen. In 2000, the government demolished Antonio Banderas' mansion, along with 50 other mansions around it.
